RockHoster Legal Agreements and Policies
RockHoster is committed to delivering reliable and secure web hosting services to our global customer base. To maintain an efficient, secure, and responsible hosting environment, all clients must comply with the following Terms of Service (TOS). These policies are in place to protect RockHoster, its clients, and its network infrastructure.
1. Indemnification Policy
By using RockHoster services, you agree to assume full responsibility for the use of the services provided. RockHoster expressly disclaims any implied warranties, including those of merchantability and fitness for a particular purpose. Under no circumstances shall RockHoster be held liable for any loss of data, business interruption, or any special, incidental, or consequential damages.
You agree to indemnify, defend, and hold RockHoster, its officers, employees, and agents harmless from any claims, losses, liabilities, costs, or expenses arising from:
- Use of services provided by RockHoster.
- Products or services sold through your website hosted on RockHoster servers.
- Any personal injury or property damage caused by your products or services.
- Copyright infringement, defamation, or any other legal issues related to your content.
2. Billing Policy
RockHoster offers the following billing cycles: monthly, quarterly, semi-annual, bi-annual, tri-annual, and annual. Payments must be made before the start of each billing cycle, and accounts will renew automatically unless canceled prior to renewal.
Accepted payment methods include:
- Visa, MasterCard, American Express, Discover
- PayPal, Bitcoin, Skrill, Perfect Money
Payment Setup
If paying via credit card, debit card, net banking, or PayPal, your account will be set up immediately once the payment is confirmed. If paying by cheque, please allow 5 days for the cheque to clear. Accounts paid via postal orders or cash will be set up on the same day.
Refund Policy
RockHoster offers a 14-day money-back guarantee for hosting plans. However, refunds are not applicable to the following products and services:
- Domain registration, transfer, and renewal
- cPanel, Plesk, Control Panel, LiteSpeed, Softaculous
- Paid support services
- SSL Certificates, Sitelock, SpamExperts, WHMCS
- Windows OS, SQL
- G Suite, Office 365
- Any other paid licenses or third-party services
The 30-day money-back guarantee is applicable only to first-time signups. If you have previously signed up with RockHoster, canceled, and signed up again, or if you have opened a second account, you will not be eligible for a refund.
3. Late Payments
Payments must be made by the due date stated on the invoice. Accounts that are overdue by 2 days will be suspended. If payment is not made within 5 days of the due date, the account may be terminated and all associated data will be permanently deleted. RockHoster will send email reminders prior to deactivation.
4. Acceptable Use Policy (AUP)
RockHoster services must be used for lawful purposes only. The following activities are strictly prohibited:
- Hosting copyrighted content without proper authorization.
- Distributing or promoting content related to hate speech, violence, illegal activities, or adult content.
- Engaging in phishing, hacking, or any other fraudulent activities.
- Hosting malware, viruses, or any content that compromises network security.
RockHoster reserves the right to suspend or terminate accounts that violate this policy without prior notice. Clients are responsible for all content hosted on their accounts and agree to indemnify RockHoster for any claims resulting from violations of the Acceptable Use Policy.
5. Data Backup and Recovery
While RockHoster provides backup services as part of certain hosting plans, it is the client’s responsibility to maintain backups of their own data. RockHoster is not liable for the loss of data due to system failure, hardware issues, or human error. We recommend keeping independent backups to ensure business continuity in case of any issues.
6. Limitation of Liability
RockHoster is not responsible for any claimed damages, including incidental or consequential damages, arising from server downtime, data loss, or service interruptions. The maximum liability of RockHoster is limited to the fees paid by the client for the services provided during the period of disruption.
RockHoster will not be held liable for any indirect losses, including but not limited to lost profits, missed business opportunities, or reputational damage due to service outages.
7. Resource Usage Policy
To ensure fair and consistent service for all clients, RockHoster enforces the following resource usage limits:
- CPU and Memory Usage: Clients must use server resources responsibly. Excessive resource consumption that negatively impacts other users may result in suspension or the need for a plan upgrade.
- Bandwidth Usage: Bandwidth limits vary depending on the hosting plan. Clients exceeding their plan’s bandwidth allocation will be required to upgrade their plan or pay for additional bandwidth.
- Storage Usage: Disk space is provided for hosting websites and related files only. Using hosting accounts as storage for backups, media libraries, or unrelated files is prohibited.
RockHoster reserves the right to monitor and take corrective action if resource usage exceeds acceptable levels.
8. Account Suspension and Termination
RockHoster reserves the right to suspend or terminate accounts without prior notice for violations of these Terms of Service or the Acceptable Use Policy. Accounts terminated for policy violations are not eligible for refunds.
Accounts with unpaid balances beyond the grace period will be terminated, and all data will be permanently deleted.
9. Service Level Agreement (SLA)
RockHoster offers a 99.9% uptime guarantee for hosting services. If RockHoster fails to meet this uptime guarantee, clients may request account credits equivalent to the downtime experienced. This uptime guarantee does not apply to scheduled maintenance or circumstances beyond RockHoster’s control, such as force majeure events, hardware failures, or DDoS attacks.
10. Intellectual Property Rights
Clients are responsible for ensuring that all content hosted on RockHoster servers complies with intellectual property laws. RockHoster will not be held liable for any intellectual property violations. In the event of a copyright or trademark infringement, RockHoster will comply with applicable laws, including the Digital Millennium Copyright Act (DMCA), and will take appropriate action, including removing infringing content or suspending the account responsible.
11. Domain Registration and Renewal
Domain name registrations are subject to availability and the rules of the applicable domain name registry. Clients are responsible for ensuring that their domain names are renewed before their expiration dates. RockHoster is not responsible for the loss of a domain name due to the client’s failure to renew on time.
Domain name fees are non-refundable. RockHoster may, at its discretion, provide renewal reminders but holds no obligation for the client's failure to renew their domain.
12. Email and Spam Policy
RockHoster has a strict no-spam policy. Any account found sending unsolicited bulk emails (spam) will be immediately suspended or terminated. RockHoster reserves the right to monitor email usage and take action if accounts are found to be violating this policy.
Clients are responsible for ensuring that their email practices comply with relevant anti-spam laws, such as the CAN-SPAM Act.
13. Privacy Policy
RockHoster is committed to protecting the privacy of its clients. We collect and process personal data in accordance with our Privacy Policy, which outlines how we collect, store, and use personal information. RockHoster does not sell or share client data with third parties without consent, except as required by law.
Clients have the right to access, correct, and request the deletion of their personal information at any time.
14. Modifications to Terms of Service
RockHoster reserves the right to modify these Terms of Service at any time. Significant changes will be communicated to clients via email or account notifications. Continued use of RockHoster services after such modifications will constitute acceptance of the updated terms.
15. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of [Applicable Jurisdiction] without regard to conflict of law principles. Any disputes arising from or related to these terms shall be resolved in the courts of [Applicable Jurisdiction].
16. Right to Refuse Service
RockHoster reserves the right to refuse service to any individual or organization at its discretion. This includes but is not limited to clients who violate our Acceptable Use Policy, engage in illegal or unethical activities, or use our services to disrupt, harass, or damage RockHoster’s reputation or operations. Any refusal of service will result in a termination of the client’s account, and RockHoster will not be liable for any damages resulting from this action.
17. Right to Access and Monitor Accounts
RockHoster reserves the right to access and monitor accounts for troubleshooting, security, and maintenance purposes. While we respect client privacy, RockHoster may access client accounts when necessary to investigate potential security breaches, policy violations, or illegal activities. All access will be conducted in compliance with applicable privacy laws and regulations.
18. Security Policy
RockHoster is committed to ensuring the security of our network and systems. Clients are expected to implement strong security measures, including the use of secure passwords and regular software updates, to protect their accounts. RockHoster is not liable for security breaches resulting from client negligence or failure to implement security best practices.
In the event of a security breach, RockHoster reserves the right to take immediate action, including suspending affected accounts, to protect the integrity of our systems and other clients. RockHoster will provide timely notification and support to clients affected by security incidents.
19. Fair Use Policy
RockHoster employs a fair use policy to ensure all clients receive equitable access to server resources. While we provide generous resource allocations, excessive or abusive use of server resources may impact other clients’ services. RockHoster reserves the right to intervene in cases of excessive usage, including throttling, suspending, or upgrading the client’s account to a higher-tier plan.
RockHoster will provide clients with ample notice and support to address resource usage concerns before taking action. Continued violations of the fair use policy may result in termination of service.
